Youth Employment UK Membership Terms and Conditions

These terms and conditions are BETWEEN:

(1) Youth Employment UK of Britannia House, 29 Station Road Kettering Northants NN16 7HH registered not-for-profit Community Interest company (08290820) limited by guarantee. (“we and us”);

and

(2) The Membership recipient which is, if the organisation named on the membership application form is an incorporated entity, (“You” and “Your” and “Member”).

1. Definitions

In this agreement the following terms shall have the following meanings:

1.1 “Start Date” The date on which You send to Us a completed Membership form and in which Membership commences.

The terms and conditions will come into effect from the date of submission of your membership form.

1.2 “Expiry date”  The date in which the Membership ceases to exist, unless renewed, at which time all publicity of your membership and member benefits will cease. 
1.3 “In Writing”  Includes by email.
1.4 “Membership” A contractual agreement between the Membership recipient (referred to as "You" or "the Member") and Youth Employment UK as the service provider. The Member shall have access to the services or benefits provided by Youth Employment UK as set out in this document. 
1.5 “Membership Period” Period from “Start Date” until “Expiry Date”
1.6 “Profile” Profile Webpage(s) held on Youth Employment’s website to advertise the services, employment opportunities and youth employment engagement of the member.

2.Service Description

Youth Employment provides three standard tiers of service: Membership, Essential Profile and Premium profile.

Extra benefits and services for Members are accessible at an additional cost and through a separate agreement beyond the scope of these Membership Terms and Conditions

Working with Youth Employment UK your commitment is to maintain and deliver against all of the Good Youth Employment Standards at all times.

Set out here are the benefits associated with each tier of membership:

2.1 Membership

As a member of Youth Employment UK, you are entitled to the following benefits:

  • Recognition of your commitment to Good Youth Employment Standards, with our Good Youth Employment Standards Membership badge for the period of your Membership
  • Self serve access to member dashboard, for up to 5 users at any one time (see 14.0 for more information on additional users)
  • Monthly newsletter on latest policy, case studies, best practice
  • Webinars and events with leading experts and young people
  • Access to our extensive up-to-date catalogue of resources and guidance and best practice.
  • Access to the Good Youth Employment Benchmark (Benchmark) which provides a custom report on organisational practice includes entry into the annual Good Youth Employment Awards (Access to the Good Youth Employment Awards is only available to those members who have completed the Good Youth Employment Benchmark)
    • Note the Benchmark opens and closes in a set period each year, and is only available for completion during this period. Custom reporting and data is not available outside this period.
  • Community voice and representation across government on key youth employment issues
  • Members networking, facilitated introductions to Members and sector-specific opportunities.

2.2 Recruitment

Organisations must hold an active Membership with us to take out our recruitment package

As part of the Youth Employment UK recruitment package you are entitled to:

  • Posting unlimited vacancies to our diverse audience with unlimited vacancy and event posting on our website opportunity finder.
  • An opportunity is defined by an active role that young people can apply for. Non vacancies/opportunities will be removed
  • An event is defined as a timely in person or virtual event which requires registration and attendance
  • All posts must comply with the Good Youth Employment Standards. Youth Employment UK reserve the right to remove any posts that do not meet the qualifying requirements.
  • The client is responsible of posting, editing and removing opportunities via their Members dashboard

Application Programming Interface (API) partnership between Your website and Youth Employment UK set up.

  • Additional cost of £250+vat where API already exists within your website.
  • Cost on Application where no API currently exists.

2.3 Essential Profile

As an Essential Profile holding member of Youth Employment UK, you are entitled to the following benefits in addition to 2.1 and 2.2;

  • Build of Essential Employer Profile by uploading your logo, about us section and early careers information.
  • Account Support, our team will be on hand to support you with any questions in regards to your profile or Membership.
    • All profiles have 2 hours development time per quarter to make profile updates, including updating content if required. Any activity that is outside of the allocated 2 hours per quarter will be billed at a fixed fee of £500 + vat per request.

2.4 Premium Profile

As a Premium Profile holding member of Youth Employment UK, you are entitled to the following benefits in addition to 2.1, 2.2 and 2.3;

  • Our Premium service allows you to customise your profile with your logo, about us section, early careers information,organisation benefits, up to 6 case studies and up to 2 embedded videos.
  • Quarterly report on our opportunity finder, including additional key insight into top performing content and audience trends from across our website.
  • Application Programming Interface (API) partnership between Your website and Youth Employment UK set up.
    • Free where API already exists within your website
    • Cost on Application where no API currently exists
  • Account Support, our team will be on hand to support you with any questions in regards to your profile or membership. All profiles have 2 hours development time per quarter to make profile updates, including updating content if required. Any activity that is outside of the allocated 2 hours per quarter will be billed at a fixed fee of £500 + vat per request.

2.5 Upgrading and Downgrading

2.5.1 Members have the option to upgrade their Membership tier during a Membership period. At renewal Members will continue on the upgraded tier subject to 2.4.3

2.5.2 Upgraded Membership tier will be charged at the full annual rate or as agreed in writing by a Youth Employment UK staff member.

2.5.3 Downgrading of Membership tier is available at time of renewal, requests should be made in writing to your account manager or via email to members@youthemployment.org.uk one month in advance of the renewal date.

3.0 Additional Benefits and Services

3.1 Consultancy
Outside the scope of this Membership Agreement Youth Employment UK can offer, for an additional fee, youth employment advice and consultancy services. All consultancy agreements will adhere to the terms and conditions specified within the agreement or contract pertaining to the consultancy and shall not be governed by the terms of the Membership Agreement terms and conditions

3.2 Sponsorship
Beyond the provisions outlined in this Membership Agreement, Youth Employment UK may extend sponsorship opportunities to your organisation, subject to an additional fee. All sponsorship agreements will adhere to the terms and conditions specified within the agreement or contract pertaining to the sponsorship opportunity and shall not be governed by the terms of the Membership Agreement terms and conditions

3.3 Virtual work experience

Beyond the provisions outlined in this Membership Agreement, Youth Employment UK may extend the option to create a virtual work experience package for your organisation, subject to an additional fee.

3.3.1 Collaboration and Timeliness

  • Organisations must collaborate with Youth Employment UK in a timely manner to support the development of the script, supply necessary images and videos, provide access to locations and colleagues, and ensure all content supplied is legally permissible for use.

3.3.2 Approval Process

  • Organisations are required to review and approve the copy, script, and storyboard promptly to avoid delays in production.

3.3.3 Product Duration and Renewal

  • The virtual work experience product is available for 12 months from the go-live date. Organisations must work with Youth Employment UK to ensure the product is ready within 6 months from the order date.
  • Annual renewal is required to keep the product on the Youth Employment UK website.

3.3.4 Content Changes

  • Any changes requested by the organisation after the initial launch will incur a cost per change, which will be quoted by Youth Employment UK.

3.4 Content resource creation
Bespoke content creation, for example workbooks and training material, are available on request. All bespoke content creation will adhere to the terms and conditions specified within the agreement or contract pertaining to the content creation opportunity and shall not be governed by the terms of the Membership Agreement terms and conditions

4.0 Contract Duration

4.1 The Membership period shall run for a duration of twelve (12) months, commencing from the start date/renewal date and continuing until the next occurrence of the 1st day of the month following the completion of the twelve-month period.

4.2 On expiry of your Membership you will no longer be authorised to use the Good Youth Employment Standards Badge. All other Membership benefits outlined within this agreement will also cease.

4.3 Profiles purchased part-way through a Membership period will run for a full twelve (12) month period from the Start Date, subject to a tier 1 Membership being renewed and in place during the profile term.

5.0 Cooling-Off Period Statement

5.1 As a consumer, you have the right to cancel your contract with Youth Employment UK within 14 days from the Start Date. This period, known as the "cooling-off period," allows you to reconsider your purchase without any obligation.

6.0 Cancellation Process

6.1 At the Start Date of your Membership, if you wish to exercise your right to cancel, please notify us in writing within the 14-day cooling-off period by email to members@youthemployment.org.uk.

6.2 Upon receiving your cancellation notice during the cooling-off period, we will refund all payments received from you, including the cost of standard delivery, without undue delay and in any event, no later than 14 days from the day on which we are informed of your decision to cancel. We will process the refund using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

6.3 In cases where Youth Employment UK has commenced or finalised work on a Profile build before receiving cancellation notice, Youth Employment UK reserves the right to deduct charges for all work completed at an hourly rate of £250 + VAT

6.4 Cancellation requests outside of the initial 14 day cooling off period are not subject to a refund.

6.5 Cancellation at the time of renewal is set out in section 7.0 of this agreement.

7.0 Renewals

7.1 Organisations are required to renew annually and in doing so confirm their commitment and compliance in meeting all of the Good Youth Employment Standards.

7.2 Your organisation's Membership will automatically renew unless we receive written confirmation to terminate Membership at least 30 days prior to the renewal date.

7.3 A reminder shall be sent to you no later than forty-five (45) days prior to renewal date.

7.4 Renewals will run from the 1st day of the month following the initial 12 month membership or any year thereafter.

7.5 Members retain the option to opt out of auto-renewal; however, they are required to submit a written request to their account manager or via email to members@youthemployment.org.uk

8.0 Rights to cancel

8.1 We reserve the right not to fulfil, or to cancel your application if we are unable to obtain payment from your organisation. We reserve the right to cancel or withdraw your use of the Good Youth Employment Standards status at any time.

8.2 We reserve the right not to fulfil, or to cancel your Membership if the Member fails to adhere to the Good Youth Employment Standards or fails to meet section 10.0 our Membership Code of Conduct.

9.0 Price Information, Payment and Payment Terms

9.1 Payment can be made by BACS or Cheque and must be made within 14 days of receipt of invoice. Bank Details as set out on the invoice.

9.2 We have a statutory right under the Late Payment of Commercial Debts Regulations 2013 to add interest and late payment compensation to any overdue payments.

9.3 We reserve the right to increase the price of Membership on an annual basis. You will be informed of any fee increase in writing via your renewal letter but no later than 45 days prior to renewal.

10.0 Membership Code of Conduct

By agreeing to Membership you are in agreement with the following user conduct;

10.1 Working with Youth Employment UK your commitment to us is to maintain and deliver against all of the Good Youth Employment Standards at all times.

10.2 Reputation - Your organisation will act in accordance with all applicable local, national, and international laws and regulations. If your organisation suffers bad publicity or is brought into disrepute, Youth Employment UK withhold the right to pause or terminate your membership and/or promotion of your organisation and any opportunities with immediate effect and without notice

11.0 Acknowledgement and Publicity

11.1 You may acknowledge Membership on your website and social media using quotes from Youth Employment UK as provided in the Membership welcome pack

11.2 You are eligible to use and encouraged to use, the Good Youth Employment Badge Logo as provided by Youth Employment UK on your literature, Website and Social Media.

11.3 Youth Employment UK reserves the right to acknowledge your Membership in a manner deemed appropriate by the organisation. This may include, but not be limited to, our literature, website and social media.

12.0 Branding

12.1 You agree to comply with any branding guidelines and instructions provided to you by Youth Employment UK and will cease use of the Good Youth Employment Badge immediately if Youth Employment UK instructs you to do so in writing or when Membership ceases.

12.2 Youth Employment UK will strive to accurately represent your brand. However, you are responsible for supplying all current branding materials, including logos. Youth Employment UK cannot be held liable for any misuse of branding in cases where incorrect logos or no brand guidelines have been provided.

12.3 Assets uploaded or embedded to our website by the Member as part of the Essential or Premium Profile Membership shall remain the intellectual property of the member. The Member bears full responsibility for the content and accuracy thereof.

12.4 Youth Employment UK reserves the right to remove any content deemed inappropriate, offensive, or damaging to the reputation of Youth Employment UK.

12.5 Assets created by Youth Employment UK bearing the logo, slogan or other details of a Member made as part of a joint branding exercise remains the property of Youth Employment UK but to be used in line with any agreement.

12.6 Submission of your branding materials including logo, allows Youth Employment UK to use it for commercial and non-commercial use to promote the employer profiles. This may include, but not be limited to, our literature, website and social media.

13. Updating Information

13.1 You are responsible for utilising self-service options and completing provided systems to update profile information and vacancies.

13.2 Where Youth Employment UK inadvertently display inaccurate information please put all requests for amendments in writing to your account manager or email members@youthemployment.org.uk

13.2 Youth Employment UK strives to respond to and implement website changes within 72 business hours.

14.0 User Accounts

14.1 Registration requirements - each organisational Membership includes up to 5 staff access to a Members Area Dashboard. Further users available on request, at an additional fee.

14.2 User credentials - will be set up manually by one of the Youth Employment UK team and we endeavour to get these sent to you within 72 business hours of your Membership Start Date date

14.3 Account security and responsibilities - you are not permitted to share login credentials and if you require more staff to access the members dashboard then please enquire at members@youthmemployment.org.uk

15. Disclaimer of Warranties

15.1 The information, materials, and services provided by Youth Employment UK are on an "as is" and "as available" basis. To the fullest extent permissible by applicable law, Youth Employment UK disclaims all warranties, express or implied, including but not limited to, implied warranties of fitness for a particular purpose, and non-infringement.

16 Limitation of Liability

16.1 You expressly understand and agree that Youth Employment UK shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Youth Employment UK has been advised of the possibility of such damages), resulting from:

The use or the inability to use the services.
Unauthorised access to or alteration of your transmissions or data.
Statements or conduct of any third party on the services.
Any other matter relating to the services.

16.2 Viruses
We do not guarantee that the Youth Employment UK website (the Site) will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform in order to access this Site. You should use your own virus protection software.
You must not misuse this Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this Site, the server on which this Site is hosted or any server, computer or database connected to this Site.

16.3 Content
While we take all reasonable care to ensure the information and analysis which we share is as accurate as possible, we cannot promise that they will be complete, accurate and up to date.
Opinions and any other contents found on the Youth Employment UK website, through the organisation’s social media and via newsletters are provided by us for informational purposes only and are subject to change without notice. We are not giving you any advice (investment, financial, legal or otherwise) in respect of any of the information on this Site. You should obtain professional or specialist advice before taking, or refraining from, any action based on any information on this Site. Any reliance that you may place on the information on this Site is at your own risk.
17. Intellectual Property

17.1 Ownership:
All content and materials available on or through Youth Employment UK (the "Content") are the property of Youth Employment UK and are protected by copyright, trademark, and other intellectual property laws.
You acknowledge and agree that Youth Employment UK retains all rights, title, and interest in and to the Content, and any unauthorised use of the Content is a violation of these terms and may violate intellectual property laws.

17.2 Trademarks:
Youth Employment UK logos and names are trademarks owned by Youth Employment UK. You agree not to use these trademarks without the prior written consent of Youth Employment UK.
All other trademarks, service marks, and logos used on Youth Employment UK are the trademarks of their respective owners and are used with permission.

17.3 By accessing or using Youth Employment UK, you agree to abide by this Intellectual Property section of the terms and conditions.

17.4 Members are not allowed to use any content from Youth Employment UK for their promotional purposes without proper attribution and prior consent from Youth Employment UK.

18. Data protection and use of personal data

18.1 The information you provide will be used to process your subscription, this will involve creating a personalised login to the Youth Employment UK website, adding you to our Members mailing list and to our internal CRM system.
This information will only be used to ensure that you can access our services as required and that you are being kept up to date.
You reserve the right to be removed from our mailing list and website at any time.

18.2 We do not pass data to any third parties. You can read our full privacy statement here. If you wish to obtain a copy of your personal data held by us, then please write to us at our head office. We will store data for up to two years after your contract ends with us.

18.3 If you believe that any of the information we hold concerning you is incorrect or out of date, please provide us with accurate information by emailing info@youthemployment.org.uk You may update your company information through your online profile.

19. Variation

19.1 Youth Employment UK reserves the right to change the terms and conditions at any time upon giving you 14 days prior written notice. The most recent edition of these terms and conditions will be binding upon you. Members may exit the contract if they do not accept any proposed variation.

19.2 If any changes were made then an email to all members stating there has been a change and the link to review the updated terms and conditions will be made available.

20. No Partnership or Agency

20.1 This Agreement shall not create any partnership or joint venture between Youth Employment UK and you, nor any relationship of principal and agent, nor authorise either party to make or enter into any commitments for or on behalf of the other party.

21. Force Majeure

21.1 Either party may delay performance of an obligation under this Agreement, and in particular Youth Employment UK may delay or suspend any obligation if it cannot perform the obligation for circumstances outside its reasonable control.

22. Governing law and jurisdiction

22.1 These Terms are governed by English law and you can bring legal proceedings in respect of this Site in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

23. Entire Agreement

23.1 These terms and conditions override any contrary terms or conditions published by us in relation to any other subscriptions between you and us.
